Terms of Service Agreement

This Terms of Service Agreement ("Agreement") is entered into by and between Julie Oeder, CleanPaw Scoopers ("Company," "we," "us," or "our") and the customer ("Customer," "you," or "your") for the provision of pet waste removal services ("Services") in the state of Ohio. By using our Services, you agree to be bound by the terms and conditions outlined in this Agreement.

1. Services Provided

CleanPaw Scoopers agrees to provide pet waste removal services as described in the chosen service plan by the Customer. Service frequency, scope, and pricing will be as specified in the service plan agreed upon by both parties.

Waste will be double bagged and discarded in the customer's provided trash can. In the event the trash can is inaccessible at time of service, the bag will be either left near the garage or discarded in a customer provided bucket alongside the home.

2. Payment and Billing

Payment: Customer agrees to pay the fees associated with the selected service plan. Payment will be processed in advance monthly according to the agreed-upon frequency of service. Invoices are due upon receipt each month. Failure to pay in full after a 3-day grace period will result in cancellation of service.

One-Time service visits will be billed upfront prior to service being completed.

Billing: Services are based on a monthly subscription and charged on a monthly rate. Customer agrees to provide accurate and up-to-date payment information. CleanPaw retains the right to adjust billing as necessary with prior notice to customer.

Late Payments: Failure to make timely payments will result in termination of services.

3. Customer Responsibilities

Access and Safety: Customer agrees to provide access to the property where services are to be performed. The property should be safe for our service providers to enter. It is the Customer's responsibility to secure pets during service times. In the event pets are not contained at time of arrival for service, CleanPaw Scoopers retains the right to refuse service in the event there is concern of safety.

Property Conditions: Customer agrees to maintain a clear and safe environment for service provision, including removing obstacles that may hinder access to pet waste.

Accuracy of Information: Customer is responsible for providing accurate information about their property and service requirements.

4. Cancellation and Termination

Customer may cancel or modify services at any time.

CleanPaw Scoopers reserves the right to terminate services in the event of non-compliance with this Agreement, unsafe working conditions, or other valid reasons.

5. Weather

CleanPaw Scoopers operates in the rain or shine, so long as it is safe to do so. Customer understands that we cannot work in the event of torrential downpours, thunderstorms, high winds, flooding, accumulating snow or extreme temperatures (hot or cold). There will be NO REFUNDS in the event of missed weeks due to weather, as we will still pick up the waste from that week the following week if we are unable to re-schedule you during the same week. Service is based on a monthly subscription model. In the event there is a lot of mud present in the yard, we may elect to skip service so as not to tear up your yard.

6. Holidays

CleanPaw Scoopers does not provide service on Federal holidays of: Memorial Day, Independence Day, Labor Day, Thanksgiving Day and closes between Christmas and New Years Day. In the event your scheduled pickup falls on a holiday or closure date, we will resume service the following week as normal. There are NO REFUNDS for missed pickups, as we still must do the work of picking up waste from the week prior, upon our return the following week.

7. Liability and Indemnification

CleanPaw Scoopers shall not be liable for any damage, injury, or loss resulting from services provided, except in cases of gross negligence or willful misconduct.

Customer agrees to indemnify and hold CleanPaw Scoopers harmless from any claims, damages, liabilities, and expenses arising out of or related to the use of our services.

8. Marketing

Customer Consent: By using our Services, Customer grants CleanPaw Scoopers the right to use before-and-after photos, videos, testimonials, and feedback provided by the Customer for marketing and promotional purposes, including but not limited to our website, social media, and advertising materials.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Ohio.

10. Amendments

CleanPaw Scoopers reserves the right to amend or modify this Agreement at any time without notice.

By using our Services, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined in this Agreement.
